Investools Repudiates Jana Complaint

NEW YORK -- According to Investools Inc. (NASDAQ:SWIM), the lawsuit filed on Friday, June 2, 2007, by Jana Partners LLC against Investools Inc., thinkorswim, Inc. and others lacks merit. Jana violated the understanding it reached with Investools to provide financing in connection with the thinkorswim merger, causing Investools to drop Jana as a partner in the transaction. Jana is now attempting through litigation to extract money to which it is not entitled. The Company intends to vigorously defend against this lawsuit.
