Home Diagnostics Wins Summary Judgment in Patent Infringement Case with Roche
Business Wire, March 5, 2007
FORT LAUDERDALE, Fla. -- Home Diagnostics, Inc. (Nasdaq:HDIX), a leading manufacturer and marketer of diabetes testing supplies, announced today that on March 2, 2007, the United States District Court, Southern District of Indiana, Indianapolis Division granted a Summary Judgment ruling in favor of Home Diagnostics for non-infringement and denied the Roche Diagnostics Corporation, Roche Diagnostics Operations, Inc. and Corange International Ltd. (collectively, "Roche") motion for a Summary Judgment of patent infringement in the patent infringement lawsuit over the TrueTrack Smart System[R] and TrackEASE Smart System[R]. In their complaint, Roche alleges that the TrueTrack and TrackEASE blood glucose monitors infringe on U.S. Patent No. 5,366,609, relating to a biosensing blood glucose monitor with a pluggable memory module.
J. Richard Damron, Jr., President and Chief Executive Officer, said, "We are extremely pleased with the Court's Summary Judgment rulings in our favor. The Court's rulings validate our long-standing position that the lawsuit was without merit."
