TCI and 3G Comment on Federal Court Ruling

NEW YORK -- The Children's Investment Fund Management (UK) LLP ("TCI") and 3G Capital Partners, Ltd. ("3G") issued the following statement on today's decision by the Federal District Court for the Southern District of New York related to their litigation with CSX Corp (NYSE: CSX):
"We are pleased that shareholders will be able to determine the outcome of the June 25th Board election. We strongly believe we have complied with all securities laws and plan to appeal. This decision should not obscure the substance of the debate: CSX shareholders have been fully informed for six months through our SEC filings that TCI and 3G are acting as a group and that we have nominated five highly qualified directors for election to CSX's Board of Directors. We are confident that our proposed directors can help CSX significantly enhance its operations for the benefit of shippers, employees and shareholders, and we urge shareholders to vote the BLUE card for their election to the Board."
