African American-Owned Company Canady Technology to Seek Twenty-Six Million Dollars in Damages against ConMed Corporation and Attorney Fees in Excess of Five Hundred Thousand Dollars against Erbe Elektromedizin GmbH

August 27(th), 2007, United States International Trade Commission, Washington, D.C., In re the Matter of Certain Endoscopic Probes for Use in Argon Plasma Coagulation Systems, brought by Complainants Erbe Electromedizin GmbH and Erbe USA, Inc. against Canady Technology, LLC and Canady Technology Germany GmbH. During the opening statement of the trial at the International Trade Commission on August 27th, 2007, Erbe Elektromedizin GmbH and Erbe USA announced that Erbe was withdrawing its claims of trademark infringement against Canady Technology. Erbe had claimed that it held a valid U.S. trademark for the color blue for tubing on flexible APC probes.

January 16, 2008 United States International Trade Commission, Washington, D.C., In re the Matter of Certain Endoscopic Probes for Use in Argon Plasma Coagulation Systems, brought by Complainants Erbe Electromedizin GmbH and Erbe USA, Inc against Canady Technology, LLC and Canady Technology Germany GmbH. On January 16, 2008, the Administrative Law Judged issued an Initial Determination on Violation of Section 337 and Recommended Determination on Remedy and Bond, Inv. No. 337-TA-569 finding that Respondents had not violated the laws by importing any products that infringe U.S. Patent No. 5,720,745 and Erbe had failed to establish the existence of a domestic industry for products covered by the '745 patent.

March 7, 2008, Canady Technology Canady Technology seeks twenty-six million dollars in damages from ConMed for tortious interference with Canady Technology's business expectancy. Canady also intends to seek attorney fees for over five hundred thousand dollars against Erbe under U.S. patent and trademark laws in connection with ERBE's failed claims of patent and trademark infringement against Canady Technology. A jury trial is set in U.S. District Court for the Western District of Pennsylvania for May 7th, 2008.
