Syntax-Brillian Corporation Receives NASDAQ Notice

TEMPE, Ariz. -- Syntax-Brillian Corporation (Nasdaq:BRLC) today announced that on May 15, 2008, the Company received a NASDAQ Staff Determination Letter stating that the Company is not in compliance with NASDAQ Marketplace Rule 4310(c)(14) as a result of its failure to timely file its Quarterly Report on Form 10-Q for the quarter ended March 31, 2008. As announced earlier this month, the NASDAQ Listing Qualifications Panel granted Syntax-Brillian's prior request for continued listing on The NASDAQ Stock Market, notwithstanding the delay in the filing of the Company's Quarterly Report on Form 10-Q for the period ended December 31, 2007. In accordance with the Panel's decision, among other things, Syntax-Brillian is required to file the December Form 10-Q by July 31, 2008.
The recent Staff Determination Letter, which was expected, invited the Company to present additional information regarding the March 10-Q filing delay to the NASDAQ Listing Qualifications Panel for its review by no later than May 22, 2008. Syntax-Brillian is preparing additional information pursuant to this request and expects that its shares will continue to be listed on The NASDAQ Global Market during this process. However, there can be no assurance that the Listing Qualifications Panel will grant the Company's request for continued listing.
