Document Security Systems Retains NYSE Alternext US LLC Listing

ROCHESTER, N.Y. -- Document Security Systems, Inc., (NYSE Alternext US LLC: DMC) a leader in patented protection against counterfeiting and unauthorized copying, scanning and photo imaging, announced today that the NYSE Alternext US (the "Exchange") has accepted the Company's plan of compliance and will continue to list the Company's Common Stock while the Company works to regain compliance with the Exchange's listing criteria before June 2, 2010.

As previously disclosed, the Company received notice from the Exchange on December 2, 2008 that based on a review of Document Security Systems' Form 10-Q for the period ended September 30, 2008, the Company did not meet certain of the Exchange's continued listing standards related to stockholders' equity as set forth in Part 10 of the NYSE Alternext US Company Guide.

The Company was afforded the opportunity to submit a plan of compliance to the Exchange and on January 9, 2009 presented its plan to the Exchange. On January 29, 2009, the Exchange notified the Company that it accepted the Company's plan of compliance and granted the Company an extension until June 2, 2010 to regain compliance with the continued listing standards and that its listing is being continued pursuant to this extension. The Company will be subject to periodic review by Exchange Staff during the extension period. Failure to make progress consistent with the plan or to regain compliance with the continued listing standards by the end of the extension period could result in the Company being delisted from the Exchange.
