Class action suit brought against Philips

The law firm of Sheller, Ludwig & Badey has announced a consumer class action in New Jersey Superior Court against Philips Electronics North America Corporation and Philips Electronics, N.V. The suit, filed by Thomas Pacillo, was brought on behalf of all consumers who purchased a Philips 2000 Series CD-R drive, including models CDD2000 and CDD2610.

The suit alleges that Philips sold drives that are unable to record to the full capacity of a CD-R disc. The suit contends that Philips sold a defective product to thousands of consumers who paid $500 to $600 for the drives since they were first put on the market approximately two years ago.

The suit demands that Philips either refund the consumers their money and/or provide them with a functional and reliable CD-R drive. According to Jonathan Shub, lead attorney for the plaintiff and the class, "We filed this class action suit on behalf of Philips customers who bought a product that simply will not perform as Philips has represented and warranted it would. Given that situation, it is not fair that the consumers should bear the cost of this defective product. Philips should come forward and treat its customers fairly."

The suit contends that Philips is liable under both federal and state consumer product laws. Other firms joining Sheller, Ludwig & Badey in filing the action were Kohn, Swift & Graf; Law Offices of Lawrence Feldman; Hoffman & Edelson; and Kalikman & Masnik.
