The Pharmaceutical Care Management Assn. filed a lawsuit Sept. 3 seeking to prevent a Maine law requiring PBMs to disclose certain business information from taking effect. The law, LD 554, goes into effect Sept. 13 and dictates that PBMs must report to the state what the association terms "proprietary business information." The association has objected to similar requirements in the draft federal Medicare reform legislation, claiming that keeping this information private allows PBMs to maximize savings from volume purchasing.

Referring to LD 554, the association says "the law will likely result in higher drug prices for consumers and will be deemed unconstitutional." Call the association's Phil Blando at (202) 207-3614.
