Federal Judge Dismisses Lawsuit Against Proposed KS Wind Farm

The Associated Press (AP) recently reported that a U.S. district judge has dismissed a lawsuit by the Flint Hills Tallgrass Prairie Heritage Foundation that sought to ban the construction of a $190-million, 100-turbine wind farm near Beaumont, KS on the grounds that it failed to cite a proper legal claim.

According to AP, the lawsuit sought to restrict all wind power development in the area, as well as reduce tax incentives for commercial wind farms that pose a threat to local resources.

"This stretch of essentially intact tallgrass prairie is in great danger of being lost if it is fragmented by these industrial wind turbine facilities," said Flint Hills Tallgrass Prairie Heritage Foundation lawyer Victor Yannacone, Jr. "These are not isolated windmills. These are enormous, gargantuan wind turbine generators."
