SCO blocked in Germany by Univention

Rethink IT, May, 2004

While SCO Group pursues its intellectual property lawsuits against users and vendors of Linux, it has met resistance in Germany, Europe's largest open source market.

Software start-up Univention has won a temporary restraining order there against SCO's German subsidiary, preventing it from disseminating allegations of Linux copyright infringement.

Univention has reached an out of court settlement with the subsidiary that prevents SCO from making any of the following four assertions:

* Linux operating systems contain unlawfully acquired intellectual property from SCO Unix

* End users, if they use Linux, could be held liable for the violations of SCO intellectual properties

* Linux is an unauthorized derivative or Unix

* Buyers of Linux operating systems other than SCO Linux or Caldera Linux may be subject to criminal prosecution.

Univention now says it is investigating whether SCO is violating the agreement
