Neither TCEQ nor the Office of the Attorney General will comment on pending lawsuits. It will be interesting, however, to see how they respond to Ryan's charges that TCEQ violated its own rules and interpretation of rules (per the Ivie letter) in the Key reimbursement case.

Given the disparate handling of his case and that of OES, Key recently told EI NEWS he is considering filing for bankruptcy for Key Associates. That may be the only way, he surmised, to force TCEQ to release funds from unpaid claims so that he can pay ECI and his subcontractors.
