A harder case for asylum
Advocate, The, April 12, 2005
Lawmakers in the U.S. House of Representatives have touted their February passage of a new immigration bill as a weapon in the war on terror. But gay rights activists say the measure, which is now before the U.S. Senate, is also a weapon against gays fleeing persecution.
The Real ID Act places "unreasonable demands" on asylum seekers with more procedural roadblocks, said Victoria Neilson, legal director for Immigration Equality. Under the bill's stricter guidelines, gays would have a much more difficult time proving they were persecuted. Middle Eastern gays, she said, are often persecuted by police under the "smoke screen" of indecency laws, which might not lead to asylum under the new bill.
