City title sued after janitor trashes photos - photographer Darryl Jones suing Emmis Broadcasting Corp.'s 'Indianapolis Monthly' - Brief Article

A planned photo essay paying tribute to a local photographer's work has turned into a $2 million headache for Indianapolis Monthly. An after-hours janitor threw out Darryl Jones's portfolio of 400 original transparencies, representing the best of his work from the past 14 years. The film was incinerated, prompting Jones to file suit in Marion County Superior Court.

Indianapolis Monthly lawyers argue that the magazine is not to blame. "We will claim it is the fault of both the janitorial service and the management company," says Norman Gurwitz, corporate counsel for Emmis Broadcasting, the magazine's parent. The pictures allegedly were in a Federal Express box that was near the trash but not in it. Whatever the case, Mark Waterfill, the lawyer for Jones, says the magazine is responsible: "They were given the care of those transparencies."
