Bur1ington responds to lawsuit

BURLINGTON, N.J. -- An attorney for Burlington Coat Factory earlier this month said the company sees no merit in a lawsuit seeking overtime pay for hourly workers and department managers in its California stores. At press time, Burlington Coat Factory was preparing its response to the workers' motion for class certification in the suit, which was due June 19.

The legal wrangling is the result of claims by 698 hourly workers and 359 Burlington department managers from Sept. 18, 1993, to the present concerning two things: Department managers allegedly have been unlawfully classified as exempt from overtime and required to work overtime hours without compensation; and sales associates and other nonexempt employees allegedly have been required to work hours "off the clock" for which they were not compensated. Burlington has not commented on the claims.
