The Missouri Limestone Producers Association reports that the Kansas Supreme Court recently issued a unanimous decision upholding the Kansas Paving Materials Act, which blocks any city or county from competing with private industry by selling construction materials to the public. The decision reversed a lower court ruling.
The victory is a result of a three-year effort by members of the Kansas Aggregate Producers Association, Kansas Ready Mixed Concrete Association, Kansas Contractors Association and Kansas Asphalt Association to establish a clear limit on the ability of government bodies to sell construction materials.
