Former U.S. Foodservice chief executive settles severance suit

COLUMBIA, MD. -- James Miller, former chief executive of U.S. Foodservice, based here, has agreed to pay $8 million to Royal Ahold, USF's former parent company. Miller had filed a suit claiming his former employer had reneged on a promise to extend post-termination benefits and a severance payment after he resigned his position in the wake of an accounting scandal.

Ahold filed counterclaims that Miller had breached his fiduciary duties and his employment agreement. All pending litigation is terminated, but a company statement noted that the agreement does not imply acknowledgement of liability.
