Hooters sues WingHouse, alleges trade-dress copy

ORLANDO, FLA. -- Hooters of America, Atlanta-based operator and franchisor of more than 310 Hooters restaurants, is suing 10unit chain WingHouse of Florida Inc. for alleged trade-dress infringement.

According to the Orlando Business Journal, Hooters' civil suit in U.S. District Court charges that Largo, Fla.-based WingHouse copied the Hooters format by employing buxom women wearing uniform shorts and tank tops and using a decor scheme including wood accents, Christmas lights, wood-weave plates, a sports-bar atmosphere and "identical" tables and chairs.

A WingHouse official was quoted as disputing that Hooters could prove trade-dress infringement, which requires proof that customers believed the two concepts were related.
