Judge overturns $4.9M verdict against Brinker

DALLAS -- A Texas District Court judge here has overturned a $4.9 million jury verdict against Brinker International Inc. in a sexual-harassment case, saying the former employee did not provide sufficient evidence of retaliation.

An attorney of the former employee who brought the case, Julie Reid, said the ruling would be appealed. "The judge's action today was wrong because he substituted his own view of the evidence for the jury's," said attorney Edward J. Westmoreland.

Reid had testified that senior vice president Douglas Bates retaliated against her after she complained to management about the sexual harassment in 1992. The court eventually excused him from the suit.
