CMS has been granted a stay in court proceedings against its current discount-drug-card proposal to allow the agency to investigate issuing a new version of the proposal. A court-imposed injunction halting all activity on CMS's original plan remains in place. The stay provides a break in further court action so that CMS can draft a new version that will accommodate legal concerns and perhaps be more palatable to affected industries.
