Modern Brewery Age, June 12, 2000

Beer Capitol Distributing Co. of Milwaukee, WI, has filed suit in federal court against the Guinness-Bass Import Company, alleging wrongful termination. Beer Capitol has been the exclusive distributor for Guinness-Bass in Waukesha County and parts of Milwaukee County since 1992.

Beer Capitol reports that sales of Guinness-Bass products have risen from $246,000 in 1992 to $2.3 million last year.

In the suit, Beer Capitol alleges that Guinness did not provide just cause for terminating the relationship.

The suit says that Beer Capitol made "substantial capital and other business investments and expenditures to increase its distribution of Guinness-Bass products."

According to documentation in the suit, Guinness-Bass products account for 145 of the distributors profit.

The suit alleges that Guinness-Bass has violated the Wisconsin Fair Dealership Act, and alleges breach of contract. Beer Capital is also seeking monetary damages.
