Performance testing can add an extra margin of safety

David Arnold, general counsel for Reid Psychological Systems in Chicago, agrees that Purgatory Resort's approach to using performance tests is the right one.

"Performance testing is a tool that can enhance any employer's safety and drug prevention policies," Arnold said. "Performance testing is attractive to many employers because it's less intrusive than biochemical testing."

Arnold recommends that employers err on the side of caution and do a thorough job of screening job applicants. The expense of pre-employment screening and performance tests will pale in comparison to post-accident drug testing, workers' compensation and litigation costs, Arnold says.

"An employer should look at as much information as possible when hiring someone," Arnold said. "Pre-employment screening tests, reference checks and performance tests show that employers are trying in good faith to be selective in their hiring process and to maintain a safe work environment. This will help limit an employers' liability in a whole array of claims, such as negligent hiring or negligent retention."
