Better safe than sorry when it comes to granting power

Sadly, we have instances where attorneys, eager to aid their clients, are willing to sign alive and well affidavits, stating that they spoke to their client that day and that the client is aware of the sale/mortgaging of the property and is consenting to same. However, in reality the attorney had never actually met the donor of the power and is unaware as to the actual facts.

In a fast moving business environment it is understood that busy individuals are often not available in person to conduct personal transactions.

The power of attorney is a useful and convenient tool in the closing process when adequate precautions are taken to ensure the validity of the instrument and to protect the interest of the grantor of the power.
