Court Rules Against Infringers of Homeland Housewares' Magic Bullet(R) Blender

The United States District Court for the Central District of California has issued a preliminary injunction against Internet retailers Koolatron, Inc., and Leena, Inc. d/b/a; WonderfulBuys.com and YouCanSave.com. A few weeks earlier, the court issued a restraining order to help protect Homeland Housewares from the infringers. Lenny Sands, managing partner of Homeland Housewares, reports that Homeland Housewares invested more than $26 million developing and marketing its unique MAGIC BULLET® personal blender.
As sales boomed during the recent holiday season, Homeland Housewares began receiving complaints from customers who had ordered MAGIC BULLET® blenders from WonderfulBuys.com and YouCanSave.com but instead received a product "knock-off" called the MIRACLE BULLET. Homeland Housewares immediately petitioned the court for an order restraining infringers, which was issued in December 2004.
Preliminary Injunction Extends Reach of the Court Order
Enjoining Koolatron, WonderfulBuys.com, and YouCanSave.com
Homeland Housewares attorneys, Cislo & Thomas, LLP, filed suit in Federal District Court in California and obtained both the restraining order and the preliminary injunction. The preliminary injunction prohibits the infringers from using the Miracle Bullet mark or otherwise infringing the Homeland Housewares Magic Bullet® trademark or trade dress. The order also allows for expedited discovery.
