Nichols Kaster & Anderson, PLLP & Donati Law Firm, LLP Bring Nationwide FLSA Overtime Case Against Source Broadband Services and C-COR on Behalf of "Piece-Rate" Installers and Technicians

Nichols Kaster & Anderson, PLLP and Donati Law Firm, LLP have brought a putative nationwide action on behalf of installers and technicians against two telecommunications companies, Source Broadband Services, LLC and C-COR, Inc. The lawsuit was filed in the United States District Court for the Western District of Tennessee on February 12, 2008. The suit was brought by current and former employees who either worked, or currently work as installers or technicians servicing Comcast customers within a 50-mile radius surrounding Memphis, Tennessee.
Source Broadband purchased C-COR's installation business in approximately June 2007. The employees assert that both Source Broadband and C-COR unlawfully denied them overtime pay for all hours they worked over forty in a week.
Plaintiffs' attorney Rachhana T. Srey explained, "An employer may pay an employee by 'piece-rate.' However, doing so does not eliminate the employer's obligation to pay that employee overtime compensation for all hours worked over forty. Our clients routinely worked overtime hours and were not compensated with any pay for their extra hours."
Plaintiffs are represented by Donald Nichols, Paul J. Lukas, and Rachhana T. Srey from Nichols Kaster & Anderson, PLLP in Minneapolis, Minnesota, and Donald Donati and William B. Ryan from Donati Law Firm, LLP in Memphis, Tennessee. The case is entitled Brasfield et al v. Source Broadband Services, Inc. and C-COR, Inc., Case No. 08-cv-02092, W.D. Tenn.
