Market Wire, April, 2008

Call center employees represented by Nichols Kaster & Anderson, PLLP filed a wage and hour action against Illinois Bell Telephone Company d/b/a AT&T Illinois, SBC Illinois and Ameritech Illinois on April 1, 2008. The suit was filed in the United States District Court for the Northern District of Illinois. Plaintiffs allege that Illinois Bell failed to pay its call center employees for all of their time worked. The suit was started by a current call center employee, Constemecka Russell, on behalf of herself and others similarly situated. Ms. Russell claims that Illinois Bell only paid her for the time she was logged into their phone system, and not for the time she spent working when she was not on the phone.

Plaintiffs' attorney David Schlesinger explained, "It appears that Illinois Bell only pays its call center employees for the time they spend on the phone. However, these employees perform work even when they are not logged into the phone system. These employees deserve to be compensated for all their time worked."

The case is entitled Russell et al v. Illinois Bell Telephone Company, 08-vc-1871, N.D. Illinois. Plaintiffs are represented by Michele R. Fisher and David E. Schlesinger from Nichols Kaster & Anderson, PLLP, which has offices in Minneapolis, Minnesota and San Francisco, California.
