Ninth Circuit Court to Hear Dispute Between Denice Halicki and Carroll Shelby Over Leading Lady "Eleanor," Star Car Character From "Gone in 60 Seconds"

Greines, Martin, Stein & Richland LLP announced today that the Ninth Circuit Court of Appeals will hear the dispute between Denice Halicki and Carroll Shelby and his fellow defendants Monday, August 4, 2008 at 9:00 a.m. location 125 South Grand Avenue, Pasadena, California in Courtroom 1.
As alleged in the complaint, this dispute arose when without the authority, consent or knowledge of Ms. Halicki, the defendants, led by Carroll Shelby, entered into an improper and malicious scheme and conspiracy to manufacture, market and sell "knock-offs" of "Eleanor," the leading lady car character that was reprised in her starring role opposite "Memphis Raines" (Nicolas Cage) in the 2000 blockbuster remake "Gone in 60 Seconds." In doing so, Halicki alleges the defendants knowingly and deliberately sought to capitalize on and exploit "Eleanor's" fame from the movie, even though the defendants had no association with, participation in, or connection with the creation or development of the movie or "Eleanor."

Indeed, the movie and the famous leading lady "Eleanor" star car character are the brainchild of Halicki's late husband, H.B. "Toby" Halicki, where "Eleanor" got her first starring role in the original 1974 "Gone in 60 Seconds."
This dispute has dragged on for over four years and the Ninth Circuit hearing brings Halicki closer to being able to seek redress for the defendants' allegedly unauthorized use of Halicki's trademarks and copyrights to make millions of dollars from knock-off merchandise and to repair her name in the marketplace.
