GPS Industries Terminates ProLink's License to Use the "093" Patent and Issues a Cease and Desist Notice

On February 11, 2009 GPS Industries, Inc. (OTCBB: GPSN) terminated ProLink Holding Corp.'s (OTCBB: PLKH) license to US Patent No. 5,364,093, the preeminent patent in the GPS golf course management industry. At its most basic level, this patent covers the use of acquiring distances on a golf course using GPS. ProLink, or its predecessors, had been licensing this patent since 2002. Due to the payment default and lapse of cure period, GPS Industries terminated the license and issued a cease and desist notice to ProLink.

Over the last 10 years, all of the major cart-mounted GPS companies have had a license to the '093' patent as it allows for the fundamental use of calculating distances on a golf course," stated GPS Industries' CEO David Chessler. "ProLink repeatedly failed to make timely payments over the course of their license agreement and failed to cure their most recent default forcing GPS Industries to terminate ProLink's license and accordingly, we sent them a notice to cease and desist."
