Safety, insurance, and the law: part Two in our insurance series seeks toclarify the grey areas around independent operators and WCB liability

Canadian Forest Industries, Mar 2003 by Belanger, Charles, Janveaux, Luc

The WSIB cautions that a clearance certificate is not proof that a person has optional insurance for themselves. It states that an "independent operator who does not obtain optional insurance with the WSIB may sue the principal and any other person or company for negligence." Operators must indeed do their due diligence or assume risks that may be far beyond their financial capabilities.

Luc Janveaux is a recent owner of a medium size forestry operation and specializes in safety in the workplace. He is currently finishing up his MBA. Charles Belanger is a business professor at Laurentian University in Ontario.
