AUTOMOBILE ACCIDENTS

Phan v. Cowden, Colo., settled before filing, Nov. 29, 2000.

Phan, 47, was a passenger in a car traveling on a highway. Another vehicle allegedly pulled out from an intersection and in front of the oncoming car, causing a collision. Phan suffered a closed head injury, dislocation of the lens in her right eye, and fractures of her left clavicle, humerus, and radius, and of the L2 vertebra. She is now blind in her right eye, has diminished use of her left hand and wrist, and is scarred. Her medical expenses exceeded $128,000. A transformer assembler who had earned $10.20 per hour, she is unable to return to work.

Phan sued the driver of the vehicle, alleging defendant failed to yield the right of way to oncoming traffic.

The parties settled for $1.1 million. A medical lien was later settled for approximately $18,800 on about $28,300 in benefits paid.
