Company uses box designs without permission: Breach of contract: Lost profits: Verdict

Collins v. Dimensional Impressions Cad Cam Sys. Inc., Cal., Los Angeles Super. Ct., No. BC247538, Mar. 5, 2002.

Collins entered into a written contract with a software company. For every piece of software sold with Collins's box designs, Collins would receive $100. The company reportedly sold some of its software using plaintiff's designs but failed to pay Collins. As a result, Collins allegedly suffered lost profits totaling about $247,000.

Collins filed suit against the software company, alleging that it breached the contract.

A jury awarded plaintiff $162,200.

Plaintiff's experts were William Rizzi, software design, Santa Barbara, Cal., and Cary P. Mack, accounting, San Diego, Cal.

Defendant's experts in this case were Ross Bishop, parametric CAD issues, San Jose, Cal.; Leo Denlea, CAD box issues, Pico Rivera, Cal.; and Barry Charles, accounting, Sherman Oaks, Cal.
