A tugboat was pushing an oil barge through a canal when a ship approached and passed them. The tugboat and barge ran aground, sustaining structural damage. The oil aboard the barge had to be sold at a loss in a distress sale.

The tugboat and barge owners sued the owner of the ship and its operator, alleging negligence in traveling too fast through the canal. Defendants were held jointly and severally liable for $1.16 million.
