Femia, 31, was at a nightclub when four or five other patrons attacked him, punching and kicking him. He suffered multiple facial fractures and a broken jaw and eye socket, requiring surgical repair. His past medical expenses were about $12,000.
Femia sued the nightclub owner, alleging the nightclub violated standard protocol and its own procedures by failing to remove the patrons who attacked him. The group had allegedly attacked another patron earlier in the evening.
The parties settled before trial for $445,000.
