AUTOMOBILE ACCIDENTS
Diaz v. Rucella, Ohio, Cuyahoga County C.C.P., No. 500958, June 4, 2004.
Diaz, 38, was a passenger in a car traveling through an intersection. Another car ran the red light at the intersection, striking the passenger side of the vehicle in which Diaz was riding. She suffered fractures to her left clavicle and ribs. Additionally, she suffered sprains to her left shoulder and hip. Her past medical expenses were $12,000.
A hospice home health care aide, Diaz missed about three months of work, incurring lost income of approximately $5,000.
Diaz sued the driver of the other car, alleging negligence in failing to heed the traffic light.
A jury awarded plaintiff approximately $1.06 million in damages.
Plaintiff's expert witness was Robin Hughes, occupational medicine, Tampa, Fla.
