Supplement makers sue FDA for contempt

In a suit asking that three top FDA officials be held in contempt of court for not implementing an Appeals Court decision authorizing the use of disclaimers on dietary supplements' health claims, product makers allege an agency policy of shielding pharmaceuticals from their competition. The suit asks that FDA Commissioner Jane Henney, CFSAN Director Joseph Levitt, and Office of Special Nutritionals Director Elizabeth Yetley be held in contempt and ordered to immediately authorize health claims for vitamins B and E sought by the dietary supplement manufacturers and distributors.
