However, the Consumers' Association is sceptical about these arguments. Naylor maintains: "We believe the law as it currently stands and is understood, Section 75 covers credit card transactions and we would argue that means all credit card transactions wherever they take place."

The Association worries that the current case-by-case approach adopted by many card issuers leaves too much to the discretion of the banks. Most of the banks, including Barclaycard, HSBC, Lloyds TSB, Egg, Bank of Scotland, Amex and MBNA say they consider claims relating to overseas transactions, and will treat them according to their merits.

All the major cards, with the exception of Egg, also claim to extend to second card holders the same protection enjoyed by the first named. Even MBNA which went to court disputing liability claims now makes a concession where second cardholders are concerned.
