NYSBA report on ADR in commercial cases
A new report issued by the New York State Bar Association's Dispute Resolution Section sets forth precepts to help arbitrators handle discovery in domestic commercial cases.
The report will help arbitrators balance efficiency, responsiveness to party expectations, procedural due process, and fairness in orchestrating discovery and making discovery determinations, Simeon H. Baum of Resolve Mediation Services Inc., said in a statement. Baum is the first, and immediate past chairman of NYSBA's Dispute Resolution Section.
Authors Carroll Neesemann, Sherman Kahn and John Wilkinson drafted the report based on research and interviews with members of the arbitration bar and representatives of arbitration organizations.
The report offers several precepts. One is that a discovery regimen should be specific and appropriate to the given case. In addition, ground rules governing an arbitration should be clearly established, the arbitrator should maintain control of the proceedings and move the case forward to an orderly conclusion, and discovery disputes should be resolved promptly.
The NYSBA report also lists factors an arbitrator should consider in determining the appropriate scope of discovery, such as the nature of the dispute, the characteristics of the parties, the terms of their agreement, the relevance of requested discovery and the parties' reasonable need for it, and matters of privilege and confidentiality.
The full 13-page report is available on the Web site www.nysba.org/drreport.
> Golisano joins Unshackle UpstateDays after helping toss state Democrats out of power in Albany, Paychex founder and billionaire B. Thomas Golisano has thrown his support behind Unshackle Upstate, a local coalition dedicated to making New York state more business friendly.
"Mr. Golisano is an entrepreneur who has created many jobs in this state. He understands the issues facing employers, and how they are tied to the lack of reform in Albany," Andrew Rudnick, president and CEO of the Buffalo Niagara Partnership and a founder of Unshackle Upstate, said. "We look forward to working with him to amplify our voice and strengthen our political action efforts to advance our goals of reducing state spending and improving the conditions of upstate businesses."
The three-time New York gubernatorial candidate announced earlier this year that he is moving to Florida because of New York's high taxes.
Mortgages, deeds recorded
In May, 1,398 deeds and 2,604 mortgages were filed in the Monroe County Clerk's office.
