The rules on solicitation were amended to allow lawyers to solicit business from other lawyers, including in-house counsel that may be seeking outside legal help. It's also OK to solicit business from family members or those with whom the lawyer has a close personal or prior professional relationship, Ginsburg explained.
Another of last year's changes deals with the specialist designation. Under the new rule, if attorneys advertise themselves as specialists, but they are not certified as specialists by an accredited organization, they must indicate that in the advertisement.
Ginsburg suggested that to avoid the possibility of violating the rule, it's easier to simply stay away from using the word specialist when advertising or soliciting new clients.
