One of 2 brothers cops plea in child-porn case
Deseret News (Salt Lake City), Jul 1, 2006
One of two Utah brothers has pleaded guilty to one felony count of possessing child pornography after he gave an undercover federal agent two CDs with more than 600 pornographic images, agents say.
Joseph Record, 54, entered his plea as part of a plea agreement struck with federal prosecutors. In exchange, prosecutors will drop a second felony count and ask for a sentencing reduction for Record's acceptance of responsibility and willingness to undergo sex offender therapy.
Record has also agreed to waive his right to appeal when he is sentenced in October.
"I'm very ashamed of what I did," Record said in court Monday. "There's no excuse for what I did."
According to federal charges, Record's brother, Daniel Record, had been e-mailing him child pornography images. After his arrest, Joseph Record contacted Daniel from jail and told him to remove evidence of the e-mails from his computer. Police say there was still enough evidence to prosecute him after he reportedly supplied an undercover agent with child pornography. Court records also show that Joseph Record has a prior conviction of sexual abuse of a child from 1998.
Daniel Record is also expected to accept a plea agreement next August.
