Asbestos violation brings fine to Menomonee Falls demolition company

A Menomonee Falls demolition company was fined about $59,000 Monday by the Milwaukee County Circuit Court for asbestos violations.

SCS Wisconsin Inc. challenged the Wisconsin Department of Justice on a series of asbestos violation charges it allegedly committed in 2004 while demolishing buildings at the Patrick Cudahy Inc. meat packing plant in Cudahy in 2004.

Judge Patricia McMahon ruled that SCS Wisconsin committed five violations of state asbestos laws: failure to wet the asbestos prior to and after removal, failure to carefully lower the asbestos during removal, failure to have an asbestos supervisor present during the disturbance of asbestos, failure to remove the asbestos before demolition of the structure commenced and failure to seal the asbestos in leak-tight containers.

As a result of McMahon's ruling, SCS Wisconsin must pay $58,735.50 in forfeitures and costs.

According to a DOJ, "The dangers to human health of asbestos and improper asbestos removal are well known and compliance with Wisconsin's asbestos removal regulations is essential in preventing a serious hazard to the environment and to public health. DOJ will continue to work with the Department of Natural Resources to enforce these essential regulations."

The DOJ filed the lawsuit at the request of the DNR.
